Family Photo Session Agreement

NIQUEA.D Customer Photoshoot-Day Agreement

This one-page addendum is intended for customers of NIQUEA.D participating in a mini photo session with BA Photography on the photoshoot day. By signing below, the customer confirms they understand and agree to the following terms.

1. Session Details. The mini session is expected to last approximately 15–20 minutes. Customer is responsible for arriving on time and being ready at the scheduled session time. Late arrivals, missed appointments, or uncooperative participants may reduce or eliminate shooting time, and BA Photography is not required to extend the session, reshoot, or provide a refund.

2. Payment. The mini session fee is $50 per session and is due at the time of the sitting, payable by cash, check or Venmo. BA Photography may withhold final edited photos until all required payments have been received.

3. Hold Harmless and Release of Liability. Customer agrees to release, indemnify, defend, and hold harmless BA Photography and its owners, employees, contractors, agents, representatives, successors, and assigns from and against any and all claims, demands, losses, damages, liabilities, costs, expenses, or causes of action, including reasonable attorneys’ fees, arising out of or related to Customer’s participation in the photo session, including any personal injury, property damage, loss, illness, accident, or other harm, except to the extent caused by BA Photography’s gross negligence or intentional misconduct.

4. Editing, Selection, and Delivery. BA Photography retains sole discretion over image selection, editing style, color correction, cropping, and final delivery format. Final edited photos will be provided within 3 business days after the applicable session, provided payment has been received and delivery is not delayed by circumstances beyond BA Photography’s reasonable control. Unedited or raw image files are not included.

5. Image Rights and Use. BA Photography owns the photographs and related work product. Customer receives a limited, non-exclusive, non-transferable license for printing and personal use only. Customer may not sell, edit, materially alter, license, sublicense, or use the images for commercial advertising or promotional purposes without BA Photography’s prior written consent. BA Photography may use the images to promote its photography business without additional compensation to customer, and such use is not limited to any particular format, platform, or medium, including but not limited to social media posts, websites, portfolios, advertisements, printed materials, displays, or other promotional uses.

Please review before your session. You will sign a printed copy when you arrive at our Cranberry Township boutique.
